MemoryPort Privacy Policy

MemoryPort (“MemoryPort,” “we,” “us,” or “our”) respects your privacy and is committed to protecting it through this Privacy Policy. This Privacy Policy explains how we collect, use, disclose, and safeguard information when you visit or use MemoryPort’s websites, applications, and services that link to this Privacy Policy (collectively, the “Service”).

MemoryPort is operated by HistoryIT, Inc. (“HistoryIT” or the “Company”). The Service is currently available at memories.lifeweb360.com and any other websites or subdomains that link to this Privacy Policy.

By using the Service, you acknowledge that you have read and understood this Privacy Policy. If you do not agree, please do not use the Service.

1. Scope and relationship to other terms

This Privacy Policy applies to information we collect through the Service. It does not apply to information collected offline or through third-party websites, applications, or services, even if those third parties are integrated with or accessible through the Service.

Your use of the Service may also be governed by our Terms of Use and other posted terms or policies. If there is a conflict regarding privacy, this Privacy Policy controls.

2. Information we collect

We collect information in the following categories:

2.1 Information you provide to us

  • Account and registration information (for example, your name, email address, username, password, profile photo, and similar account details).
  • Profile information you choose to provide (for example, a bio, location, or other optional details).
  • Memorial or “honoree” information and information about others that you or other users provide in connection with memorial pages and User Content (for example, names, dates, relationships, biographies, and photos). You are responsible for ensuring you have the right to share this information and, where applicable, obtaining appropriate permissions.
  • User Content you submit, post, upload, transmit, or otherwise make available through the Service, such as messages, memories, photos, videos, audio, comments, and captions. We may also collect metadata associated with User Content (for example, timestamps, tags/hashtags, and, if enabled by you or your device, location or geotag information).
  • Communications and support information when you contact us (including customer support) or respond to surveys, promotions, or requests for feedback.
  • Purchase and transaction information if you buy products or services through the Service (for example, billing address, shipping address, and details of what you purchased).
  • Fundraising and donation information if the Service offers fundraising pages or donation features (for example, campaign details, donor information, donor messages, and donation amounts).

2.2 Information we collect automatically

  • Device and usage information, such as IP address, browser type, device identifiers, operating system, language, pages viewed, referring URLs, clicks, and the dates and times of access.
  • Cookies and similar technologies (for example, cookies, pixels, SDKs, and local storage) that help the Service function, remember preferences, understand usage, and support analytics and other purposes described in Section 6.

2.3 Information we receive from third parties

  • Service providers and vendors that help us operate the Service (for example, hosting providers, content storage providers, analytics providers, fraud prevention providers, and customer support tools).
  • Third-party integrations (such as social networks) if you choose to connect or interact with them through the Service, depending on your settings and authorizations.
  • Public sources in limited circumstances (for example, to help prevent fraud or to improve accuracy).

3. How we use information

We may use information we collect to:

  • Provide, operate, maintain, and improve the Service and its features.
  • Create and administer accounts; verify email addresses; and authenticate users.
  • Enable community interactions and the creation, display, and organization of memorial pages and User Content.
  • Process transactions, fulfill orders, and provide purchase-related support.
  • Provide customer service, moderation, and respond to inquiries and requests.
  • Personalize content and user experiences, including remembering preferences.
  • Conduct analytics, debugging, quality assurance, and product development.
  • Detect, prevent, and address fraud, abuse, security incidents, and violations of our Terms of Use or other policies.
  • Comply with legal obligations, protect our rights, and enforce our agreements.
  • Communicate with you about the Service, including administrative and security messages, and, subject to your choices and applicable law, marketing communications.

4. How we disclose information

We may disclose information as follows:

4.1 Public and community sharing (User Content visibility)

The Service is designed to support sharing memories and content. Depending on the privacy settings for a particular memorial page and your actions, User Content may be viewable by other users and/or the public. Please do not post information you would not want shared.

Even if content is restricted, it may be shared by others who have access, and copies may persist through caching, archiving, screenshots, or re-posting. We cannot control what others do with content once they have access to it.

4.2 Service providers

We may share information with vendors and service providers that perform services on our behalf (for example, hosting, content storage, analytics, email delivery, customer support, and fraud prevention). These parties are authorized to use information only as necessary to provide services to us.

4.3 Payment processing

If you make purchases or donations through the Service, payments are processed by third-party payment processor(s) (for example, Stripe). The payment processor’s privacy policy applies to the information it processes in connection with payments. We do not control those practices, and we generally do not store full payment card numbers.

4.4 Affiliates and corporate transactions

We may share information with our affiliates for purposes consistent with this Privacy Policy. If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, dissolution, or sale of all or a portion of our assets, information may be transferred as part of that transaction, subject to applicable law and appropriate protections.

We may disclose information if we believe in good faith that doing so is necessary to comply with applicable law, regulation, legal process, or governmental request; to protect the rights, property, or safety of the Company, our users, or others; to investigate, prevent, or take action regarding suspected illegal activity, fraud, or security issues; or to enforce our terms and policies.

4.6 With your direction

We may share information at your direction or with your consent (for example, when you choose to share content to third-party services).

5. Data retention

MemoryPort is designed to preserve memories. By default, the Service may retain your photos, stories, and other User Content indefinitely unless you delete it or request deletion, subject to technical limitations and legal obligations.

Institutional archive copies. MemoryPort is used by museums, archives, historical societies, and similar organizations (our “Institutional Clients”) to build digital collections. If you contribute User Content to a tribute page, collection, or project administered by an Institutional Client, that Institutional Client may access, download, export, and retain copies of that content in its own digital archives. Institutional Clients may also use and display archived content (including in online or physical museum exhibits) consistent with the permissions and rights they have obtained. Deleting your account, deleting content, or ceasing to use MemoryPort will not automatically delete or recall copies that an Institutional Client has already retained or displayed. Requests to delete or remove content from an Institutional Client’s archives should be directed to that Institutional Client.

If you delete your account or content, we will take steps to remove it from active display and/or access within the Service, subject to technical limitations. However, we may retain archived or backup copies as necessary for legitimate business purposes such as security, fraud prevention, system backups, dispute resolution, legal compliance, and enforcement of our agreements.

Third parties (including search engines, archival services, or other users) may store, display, or re-share copies of content outside our control. We cannot guarantee removal of copies stored or displayed by third parties.

6. Cookies, analytics, and tracking

We and our service providers may use cookies and similar technologies to:

  • Provide essential functionality (for example, authentication, security, and load balancing).
  • Remember preferences and settings.
  • Understand usage and improve performance (analytics).
  • Measure and improve our communications and marketing (for example, to understand whether an email or campaign led you to the Service).

You can manage cookies through your browser settings. If you disable cookies, some parts of the Service may not function properly.

Some browsers transmit “Do Not Track” signals. At this time, we do not respond to “Do Not Track” signals.

If we engage in interest-based advertising in the future, you may be able to opt out of some forms of interest-based advertising through industry programs such as the Digital Advertising Alliance (aboutads.info) and the Network Advertising Initiative (networkadvertising.org).

7. Security

We implement reasonable administrative, technical, and physical safeguards designed to protect information. However, no method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.

You are responsible for maintaining the confidentiality of your login credentials and for restricting access to your account.

8. Your choices and rights

8.1 Accessing, updating, or deleting account information

You may be able to access, update, or delete certain account information through your account settings. If you need assistance or cannot access your account settings, contact us using the information in Section 12.

8.2 Deleting content

You can delete certain User Content through the Service. In some cases, memorial pages may be administered by “Administrative Users” (for example, the person(s) responsible for a memorial page), and your ability to change visibility settings or remove content may depend on the settings for that page.

8.3 Email communications

You can opt out of promotional emails by using the “unsubscribe” link in those communications. You may still receive transactional or service-related messages (for example, account verification and security notices).

8.4 Cookies

You can usually adjust your browser settings to reject cookies or to alert you before a cookie is placed. Each browser is different, so check your browser’s help menu to learn how to change your cookie preferences.

8.5 U.S. state privacy rights

Depending on where you live and our processing activities, you may have rights under applicable U.S. state privacy laws. These rights may include the right to request access to, correction of, or deletion of certain personal information; to obtain a copy of your information; and to opt out of certain processing, such as targeted advertising or certain disclosures that may be considered a “sale” or “sharing” of personal information under some laws.

If you are a California resident, you may designate an authorized agent to submit certain requests on your behalf, subject to verification requirements. We will not discriminate against you for exercising your privacy rights.

8.6 International users (EU/UK/Switzerland)

If you are located in the European Economic Area, United Kingdom, or Switzerland, you may have rights including access, rectification, deletion, restriction, objection, and data portability. You also have the right to lodge a complaint with your local data protection authority.

If we transfer personal data from these regions to the United States or other jurisdictions, we will do so using appropriate safeguards as required by law.

9. Children’s privacy

The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn we have collected personal information from a child under 13, we will take steps to delete it.

10. Deceased users and memorial content requests

If you are contacting us about a deceased user, a memorial page, or content related to a deceased individual, please contact us at [email protected]. We may request information or documentation as appropriate and as permitted by law.

11. Changes to this Privacy Policy

We may update this Privacy Policy from time to time. We will post the updated version on this page and update the “Last Updated” date. Your continued use of the Service after changes become effective means you accept the revised policy.
